1. Terms and Definitions

1.1. For the purposes of these Terms of Service, the terms below have the following meanings: Site — the Internet resource located at https://www.actorrrate.ru. Depending on context, "Site" also refers to the Site's software, design (graphic appearance), Database — including the ACTORRRATE Rating — any section (subsection) of the Site, and any Information posted on the Site by the Site Administration or by Users. Site Administration — Stanislav Valerievich Balashov, who owns all the relevant exclusive proprietary rights to the Site, including rights to the Site's domain name, and who administers the Site. User — a person who has completed the registration and/or authorization procedure under section 3 of this Agreement, and who has their own Profile. For the purposes of these Terms of Service, "User" also refers to any person who has not completed the registration procedure but who accesses the Site and/or uses or has used it. Any person who accesses the Site thereby automatically confirms that they fully agree with the provisions of these Terms of Service and that the requirements set out herein apply to them. User Profile / Profile — a special subsection of the Site that contains the User's Personal Information and other information that only that User can post. User's Personal Information — information about a User of the Site obtained in connection with the User's use of the Site, classified as the User's personal information in accordance with the Privacy Policy (https://actorrrate.com/privacy). Information — information posted on the Site by a User or by the Site Administration, including the User's Personal Information, links to other sites, any text messages, film reviews (User Reviews), photographs (images), audio and/or video works, computer programs, the ACTORRRATE Rating, and other files. Database — the collection of Information posted on the Site. All Information posted on the Site, as well as the selection, grouping and arrangement of the Information, is the intellectual property of the Site Administration and/or other rightholders. Spam — mass, unsolicited and/or unexpected email and other mailings of an advertising, informational, promotional or other nature. ACTORRRATE Rating — a numeric value in the range from 1 to 10, including fractional values, assigned to a specific role and/or to an actor, director or other position related to the production of a specific film, series or other audiovisual work, based on User voting; it aggregates the subjective evaluations of Users with respect to specific roles and/or actors, directors and other positions related to the production of a specific film, series or other audiovisual work. Any terms and concepts used in these Terms of Service that are not defined in the "Terms and Definitions" section will be interpreted in accordance with the meaning arising from the text of these Terms of Service. In case of any disagreement as to the interpretation of a term and/or concept used in these Terms of Service, the interpretation determined by the Site Administration shall apply.

2. Subject Matter and General Provisions

2.1. These Terms of Service (the "Agreement") set out the rules and conditions for using the Site and for posting Information on it, and constitute an agreement between the User and the Site Administration which supersedes any prior agreements between the User and the Site Administration. When posting film reviews, the User must also follow the film review posting rules located at: (section to be created). 2.2. Accessing the Site, using the Site, and/or performing any other actions on the Site means that the User accepts and agrees to comply with all terms of this Agreement, as well as the documents referenced in clause 2.3. 2.3. In any matters not covered by this Agreement, the relations between the Site Administration and the User in connection with the use of the Site are governed by: the Privacy Policy (https://actorrrate.com/privacy).

3. Registration and Authorization on the Site

3.1. To access all features of the Site, the User must complete the new-user registration procedure. The User may also be offered authorization via a third-party service account that supports integration with the Site. When using a third-party service account, the User understands that the information they provided in that account is processed under the terms of the Privacy Policy (https://actorrrate.com/privacy) for the purpose of using the Site's features. 3.2. The User undertakes to provide truthful, accurate and complete information about themselves at registration and to keep this information up to date. In case of any changes to such information, the User undertakes to update their data at the time of their next login to their profile. The User acknowledges that the Site Administration is generally not obligated to verify the accuracy of the User's Personal Information and does not monitor the User's legal capacity. 3.3. The Site Administration may block and/or delete the User's Profile, refuse access to all or some of the Site's features, and delete the User's Information without giving reasons, including in case of the User's violation of this Agreement, as well as if the User provides inaccurate information about themselves or if the Site Administration has grounds to believe that the information the User provided is inaccurate, incomplete, untrue, violates this Agreement, or if the User uses another person's information. 3.4. The Site Administration reserves the right at any time to require the User to confirm the information they provided and to request supporting documents (in particular, identity documents). If such documents are not provided, or if the information in the documents does not match the information the User has provided on the Site, or if the information the User has provided on the Site does not allow the User to be identified, the Site Administration may at its discretion take the measures provided for in clause 3.3. 3.5. The User's individual login and/or password required for authorization on the Site are intended for that User only.

4. User's Personal Information

4.1. The User's Personal Information is processed in accordance with the Privacy Policy published at: (https://actorrrate.com/privacy). 4.2. In connection with providing the Service and for the performance of this Agreement, the Personal Information contained in the User's Profile, or published on the Site, is publicly available, and any User of the Site may view it — except for Personal Information whose visibility the User may limit when the Site provides the corresponding functionality. The Information the User has specified (including Personal Information), once published by the User and made available on the Site, will be displayed to an unlimited number of people solely for the purpose of providing Site functionality. 4.3. By posting their Personal Information on the Site, the User confirms that they do so voluntarily and that they voluntarily provide such Information to the Site Administration. 4.4. The User undertakes not to post on the Site the personal information of other persons, and not to use the personal information of other Users in any way that does not comply with the laws of the Russian Federation, for unlawful or illegal purposes, for profit, or for any other purpose inconsistent with the purposes for which the Site was created.

5. Posting Information on the Site

5.1. By posting Information on the Site, the User warrants that they hold all rights necessary to post the Information on the Site. If the User does not hold the appropriate rights to post any Information on the Site, the User undertakes not to post such Information. 5.2. When using the Site, the User undertakes not to post on the Site and not to use the Site to receive, send or distribute via or by means of the Site the following Information: defamatory, offensive, dishonouring/degrading the honour and/or dignity of third parties, or containing threats; violating the rights and legally protected interests of third parties; violating the right of citizens to privacy and to public order; promoting discrimination against people on the basis of race, ethnicity, gender, religion, social status, sexual orientation, or other characteristics; promoting and/or calling for changes to the constitutional order, the unleashing of war, religious, racial or interethnic hatred, containing attempts to incite enmity or calls to violence, infringing the rights of minorities; containing pornographic material or other material offensive to public morals; containing extremist material; offending the religious feelings of citizens; defaming the business reputation of the Site Administration or third parties; Information of a "sponsored" nature, i.e. Information created in someone's interests that are inconsistent with the purposes for which the Site was created. 5.2. The User also undertakes: not to post on the Site and not to send anywhere via or by means of the Site any other Information that is inconsistent with the laws of the Russian Federation and/or with this Agreement; not to distribute on the Site and/or through the Site any computer viruses or other computer codes, files or programs intended to disrupt, modify, block, destroy or restrict the functionality of any computer or telecommunications equipment or programs for unauthorized access, as well as serial numbers for commercial software and programs for generating them, logins, passwords and other means of obtaining unauthorized access to the Site or to paid resources on the Internet; not to disrupt the normal operation of the Site; not to distribute and/or use any computer programs, robots ("spiders") or other automatic algorithms and methods aimed at scraping (collecting), unlawful transfer, copying, blocking, modifying or destroying the Information and the Database, or aimed at circumventing the restrictions set by the Site Administration in the Site settings; not to post or otherwise use on the Site any Information protected by intellectual property law (including, but not limited to, Information involving patents, trademarks, copyright and/or related rights) and any other legally protected Information without the appropriate rights and permissions from the rightholder. In case of any dispute, the burden of proving that the Information posted by the User does not infringe anyone's rights lies on that User; not to post or distribute advertising on the Site without prior consent from the Site Administration; not to collect, store, distribute or otherwise process the Personal Information of other Users; not to post on the Site links to other Internet resources whose content is inconsistent with the laws of the Russian Federation and/or this Agreement; not to distribute on the Site and/or through the Site "chain letters", online earnings schemes, "pyramid" schemes, multi-level marketing, e-mail businesses, or other Spam; when registering on the Site, not to provide false Personal Information about themselves, not to register or act on the Site under the name of another real or formerly real person, not to provide third parties' personal information, and not to use any form or method of unlawfully representing third parties; not to use the Site to extort or obtain money, regardless of the pretext, from other Users and/or third parties; not to promote or solicit the use of narcotic or psychotropic substances, and not to use the Site to involve anyone in prostitution; not to assist in committing and/or commit, using the Site, any other unlawful or illegal actions contrary to the requirements of the laws of the Russian Federation and/or this Agreement. 5.2.1. The Site Administration may, at its discretion, refuse to post, delete and/or edit Information posted on the Site by the User if such Information is not related to the topic of discussion and/or has a negative character. 5.3. The Site Administration provides the User with the ability to post Information on the Site and to use the Site's services. The Site Administration bears no responsibility for the accuracy and legality of the Information posted by Users on the Site. 5.3.1. The Site Administration reserves the right to restrict the posting of information by Users on certain pages of the Site at its discretion. 5.3.2. The Site Administration reserves the right to refuse a User's request to remove Information from certain pages of the Site at its discretion. 5.4. The Site Administration does not check and has no technical or factual ability to check all Information posted by the User on the Site for compliance with the requirements of the laws of the Russian Federation and with this Agreement, because such checking would make the operation of the Site impossible. However, the Site Administration may do so at any time at its discretion if it has corresponding doubts. 5.5. The Site Administration may, at its discretion, refuse to post, delete, and/or edit any Information that the User intends to post or has posted on the Site. 5.6. A link to any site, product, service or any information of a commercial or non-commercial nature posted on the Site by a User or as advertising is not an endorsement or recommendation of those products (services) by the Site Administration.

6. Use of the Site

6.1. The User may use the Site only in accordance with this Agreement and exclusively by methods enabled by the technical capabilities of the Site. 6.2. The rightholders in respect of the Information posted on the Site are, as applicable, the Site Administration, Users, and/or third parties. 6.3. The Site Administration is the lawful rightholder and owns all exclusive proprietary and other relevant rights to the Site, including, but not limited to, the Site's software, graphics, design, the Site's Database, and the ACTORRRATE Rating. 6.4. Any Information posted on the Site by a User accordingly belongs to that User or to the relevant third party. By posting Information on the Site, the User confirms that they hold all rights and powers necessary to do so and acknowledges that such Information becomes available to other Users of the Site. 6.5. By posting Information on the Site, the User automatically grants the Site Administration, free of charge, unconditionally and irrevocably, a non-exclusive right to use such Information worldwide for an unlimited term at the Site Administration's discretion, including, but not limited to, reproducing, copying, selecting, organizing, transforming, modifying, editing, translating, publishing, distributing, broadcasting, transmitting by cable, and making such Information available to the general public (in part or in full) by any lawful means. By posting Information on the Site, the User also confirms that they have the appropriate rights and powers to grant the Site Administration the non-exclusive right described above. When using such Information, the Site Administration may use it either with attribution to the author or without attribution (where attribution is shown, it will be the name (alias) the User provided at registration or in Profile settings, or the User's login). The Site Administration may transfer the rights described in this clause to third parties. 6.6. Unless expressly permitted by the Site's services, the User or any third party is not allowed to modify, copy, delete, store, scrape, distribute, transmit, sell, "post" or otherwise use the Information posted on the Site (other than Information that has been lawfully posted on the Site by that User themselves) without prior permission from the Site Administration and/or the relevant rightholder, except where the Site Administration and/or rightholder has explicitly given permission for the free use of the Information by anyone. Use of the ACTORRRATE Rating is allowed only with prior permission from the Site Administration, with mandatory indication that the rating is the ACTORRRATE Rating and with a link to the Site. 6.7. Users undertake to use the Information, as well as any other information contained on the Site, solely for personal non-commercial purposes, except where permission for other use is granted by the Site Administration and/or the relevant rightholders. 6.8. The Site provides the authorized User with the ability to exchange messages with other Users of the Site and with the Site's support team. For the purpose of monitoring compliance with this Agreement and complying with the requirements of legislation and regulatory documents, the Site Administration stores the history of interactions between Users via the relevant Site features. 6.9. The User uses the Site's software free of charge.

7. Operation of the Site and Liability in Its Use

7.1. The Site Administration endeavours to ensure the proper operation of the Site around the clock; however, the Site Administration bears no liability if any disruptions to the Site's operation occur for any reason. 7.2. The Site Administration does not guarantee that the Information posted on the Site will be available at any time or will not be deleted or lost. The Site Administration is not liable for failures or delays in the operation of the Site or for any possible consequences of such failures or delays. 7.3. The Site Administration is not liable for any leak of Information from the Site's Database for any reason, including as a result of unauthorized actions by third parties. 7.4. The Site Administration is not liable for the presence of viruses on the Site, nor for the possible consequences of the User's computer being infected with viruses or of other malicious software reaching the User's computer. The Site Administration provides the Site to the User "as is" without any additional warranties. 7.5. Any recommendations made by the Site Administration to the User using the technical means of the Site, including in the "Personal Recommendations" section, are merely a prediction made on the basis of the ratings the User has submitted, using the mathematical methods underlying the calculation of the User's preferences. These recommendations may not match the User's actual preferences, their views on morality, or their aesthetic taste. The Site Administration is not liable for any mismatch between the recommendations offered and the User's actual preferences. 7.6. The Site Administration does not answer for, reimburse or bear liability for any loss, including lost profit, moral or other damage, caused to the User or to third parties as a result of their use of the Site or in connection with the operation of the Site, as well as in all other cases provided for by this Agreement. Under all circumstances, the liability of the Site Administration under article 15 of the Civil Code of Russia is limited to RUB 10,000 (ten thousand rubles) where it is at fault. 7.7. The User is solely and fully responsible for the Information they post on the Site and/or communicate to other Users or third parties by means of the Site, including for its content and compliance with the laws of the Russian Federation, and for any infringement of third parties' rights in the Information posted and/or communicated by the User (including, but not limited to, copyright and/or related rights, rights to means of individualization, trade secret rights and other legally protected rights). The User shall solely compensate any loss (including lost profit, moral or other damage) incurred by other Users, third parties or the Site Administration as a result of such violations and/or as a result of the posting of such Information on the Site, and/or as a result of communicating such Information by means of the Site, or as a result of other actions in connection with the use of the Site. 7.8. The Site Administration is not liable under agreements between Users and/or between a User and any third parties entered into using the Site. 7.9. The User undertakes, by their own efforts and at their own expense, to resolve all disputes and to settle all claims and lawsuits from third parties, as well as orders and demands from authorized state authorities, received either by the User or by the Site Administration in connection with the User's posting of Information on the Site, and to reimburse all losses and expenses incurred by the Site Administration in connection with such claims and lawsuits.

8. Other Provisions

8.1. This Agreement is governed by and shall be interpreted in accordance with the laws of the Russian Federation. Matters not addressed by this Agreement shall be resolved in accordance with the laws of the Russian Federation. All possible disputes arising from the relations governed by this Agreement shall be resolved in the manner established by the current legislation of the Russian Federation, under the norms of Russian law. Throughout the text of this Agreement, unless explicitly stated otherwise, the term "legislation" means both the legislation of the Russian Federation and the legislation of the User's place of residence. 8.2. The User and the Site Administration shall attempt to resolve any disputes and disagreements arising between them through negotiation. If disputes and disagreements cannot be resolved through negotiation, they shall be subject to consideration in the appropriate court at the location of the Site Administration. 8.3. With respect to the use of the Site's features for receiving the free-of-charge services provided under this Agreement, the consumer protection rules established by the laws of the Russian Federation are not applicable to the relations between the User and the Site Administration. 8.4. Nothing in the Agreement shall be construed as establishing between the User and the Site Administration any agency, partnership, joint-activity, personal employment or any other relations not explicitly provided for by the Agreement. 8.5. If, for any reason, one or more provisions of this Agreement are found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions. 8.6. Inaction by the Site Administration in the event of a violation of the Agreement by the User or other users does not deprive the Site Administration of the right to take appropriate action to protect its interests at a later time, nor does it mean that the Site Administration waives its rights in the event of any subsequent similar or comparable violations. 8.7. This Agreement is drawn up in Russian and in some cases may be made available to the User for review in another language. In case of any discrepancy between the Russian-language version of the Agreement and a version in another language, the provisions of the Russian-language version of this Agreement shall apply. 8.8. The Site Administration may modify this Agreement at any time without any special notice. The new version of the Agreement comes into force from the moment it is published on the Site, unless the new version provides otherwise. 9. Use of Web Analytics Services

9.1. The Site Administration uses the Yandex.Metrica web analytics service provided by Yandex LLC ("Yandex") to collect anonymized statistics about visits to the Site and User behaviour, and to improve the operation of the Site. 9.2. The categories of data processed, the purposes of processing and the conditions for the User to opt out of processing are described in the Privacy Policy, as well as in the Yandex documents: "Terms of use of Yandex.Metrica" (https://yandex.com/legal/metrica_termsofuse/) and "Yandex Privacy Policy" (https://yandex.com/legal/confidential/). 9.3. By continuing to use the Site, the User confirms their consent to the processing of data by Yandex.Metrica under the conditions of the Privacy Policy.
