Definitions

Automated processing of personal data — processing of personal data by means of computing technology. Personal data information system — a set of personal data contained in databases together with the information technologies and technical means that ensure their processing. Processing of PD — any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, organization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), de-identification, blocking, deletion, or destruction of personal data. Personal data operator — a state body, municipal body, legal entity or natural person that, alone or jointly with others, organizes and/or carries out the processing of personal data, as well as determines the purposes of processing personal data, the composition of personal data to be processed, and the actions (operations) performed on personal data. Personal data (PD) — any information relating to a directly or indirectly identified or identifiable natural person (data subject). Site User — a natural person who accesses the Site over the Internet and uses the Site. Cookies — a small piece of data sent by a web server and stored on the Site User's computer, which the web client or web browser sends to the web server in each HTTP request when trying to open a page of the relevant Site. IP address — a unique network address of a node in a computer network built on the IP protocol.

1. General Provisions

This Privacy Policy (the "Policy") has been developed in accordance with the requirements of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" and sets out the principles for processing and ensuring the security of personal data when they are processed on the "ACTORRRATE" site (the "Site"). This Policy defines the procedure and conditions for processing personal data on the Site and the general conditions for the provision of services between Stanislav Valerievich Balashov (the "Site Owner") and a natural person (or their legal representative) who has created an account on the Site or who uses the Site without an account, and also sets out the rights of PD subjects and the responsibility for violating the procedure for processing PD. This Policy defines the Site Owner's policy with respect to the processing of PD of Site Users, performed by the Site Owner for the execution of the TERMS OF SERVICE (https://actorrrate.com/tos), or where the Site Owner has other legal grounds (for example, consent of the Site Users to the processing of personal data in particular cases, or where processing of PD is necessary for the Site Owner to achieve purposes prescribed by law, or otherwise). The User (or their legal representative) acknowledges that they have read, agree with the conditions of and accept this Policy. This Policy applies to all information that the Site Owner may receive about the Site User during the Site User's use of the Site, of any programs related to the Site, and of the services of the Site. The purpose of this Policy is to ensure that the operation of the Site complies with the requirements of the laws of the Russian Federation in the area of PD processing. This Policy applies to PD processing operations on the Site and to all structural subdivisions and employees of the Site Owner involved in those operations. If the Site User (or their legal representative) does not agree with any of the conditions of this Policy, they shall stop using the Site and delete their account. This Policy applies only to the Site; the Site Owner does not control and bears no liability for sites of third parties that the Site User may visit via links available on the Site.

2. Principles and Rules for Processing PD

The Site Owner processes PD on a lawful and fair basis, limited to achieving specific, predefined and lawful purposes. The Site Owner stores PD no longer than required by the purposes of PD processing, unless a different storage period is established by federal law for data that the Site Owner is required to retain under that law. The Site Owner processes PD in an automated manner in personal data information systems.

3. List of Site User PD Processed

This Policy establishes the Site Owner's obligations to maintain confidentiality of and ensure the protection of PD that the Site User provides upon registration on the Site and/or in connection with further use of the Site. Data are provided by the Site User by filling out registration forms, personal-account forms, or by another means provided for, and may include the following information: full name; the User's email address; phone number; any other information provided by the Site User on their own initiative, except special categories of PD. The Site Owner additionally processes data that are automatically transmitted on visit, taking into account User settings: IP address; information from cookies; information about the browser (or other program used to access the Site); access time; page address; referer (the address of the previous page); user ID. The Site collects statistics about Site Users' IP addresses. This information is used to identify and resolve technical problems.

4. Purposes of Collecting Site User PD

The Site Owner may use the User's PD for the purposes of: registration and authorization on the Site; providing Site Users with the ability to use the Site without restriction, identifying Site Users in order to provide them with personalized settings and Site recommendations, verifying that Site Users have reached a certain age when using the Site; promoting goods, work and services on the market by means of direct contact with the Site User via communication channels, provided that the subscriber or addressee has given prior consent to receive advertising over telecommunications networks, including showing the Site User advertising matching their interests; selling goods and services to Site Users over the Internet; enabling communication with the Site User, sending them notifications, requests and information, and receiving and processing requests, complaints and applications from Site Users; running campaigns, promotional activities and contests for Site Users; conducting marketing, statistical and audience research, and analytics including Site User satisfaction surveys; providing third parties with access to the Site.

5. Methods and Periods of PD Processing

PD of the Site User is processed until the date the User's account is deleted, which will be considered a unilateral refusal by the Site User to perform the Terms of Service, and/or until the date of withdrawal of Consent to the processing of personal data, where processing of Personal Data was carried out by the Site Owner on the basis of Consent to processing the Site User's PD. In case of deletion of the Site account or withdrawal of Consent to processing personal data (in certain cases), the Site Owner informs the third party about it if PD processing is performed by such a third party acting on behalf of the Site Owner, and, if storage of PD is no longer required for the purposes of PD processing, destroys the PD or ensures their destruction (if PD processing is performed by another person acting on behalf of the Site Owner) within the period established by the legislation of the Russian Federation, unless otherwise provided by federal law. The Site Owner may transfer personal data to third parties, the list of which is published on the Site. Such persons are independent PD processing operators and independently ensure the grounds for processing Site Users' PD. PD of the Site User may be transferred to authorized state authorities of the Russian Federation only on the grounds and in the manner established by the laws of the Russian Federation. PD of the Site User are destroyed when: the Site User independently deletes their data; the Site Owner deletes the information posted by the User. If the Site User's account is deleted, the Site Owner stores on its electronic media the personal and other necessary data of the Site User for the period established by the current legislation of the Russian Federation. If the User restores their account before the end of such period, PD of the Site User is processed in accordance with this Policy.

6. Site User Rights

The Site User (or their legal representative) may request the clarification of their PD, their blocking or destruction if the PD are incomplete, outdated, inaccurate, unlawfully obtained or not necessary for the declared processing purpose.

7. Implemented Measures for Ensuring PD Security

When processing PD, the Site Owner takes the necessary legal, organizational and technical measures to protect PD against unlawful or accidental access to them, destruction, modification, blocking, copying, provision, distribution of PD, and against other unlawful actions in respect of PD, in accordance with Federal Law No. 152-FZ of 27.07.2006 "On Personal Data".

8. Use of Yandex.Metrica

The Site uses the Yandex.Metrica web analytics service provided by Yandex LLC ("Yandex") to collect anonymized statistics about visits to the Site and User behaviour. Yandex.Metrica processes the following categories of data: the User's IP address, cookies, browser and device information, the time and addresses of visited pages, referer, the user identifier on the Site (User ID, without disclosing personal data), interface interaction events (clicks, scrolling, form filling without field values), and session recordings using the "Webvisor" technology. Processing purposes: measuring traffic, analyzing User behaviour, improving the Site, detecting and resolving bugs, evaluating the effectiveness of product changes. Legal basis: the User's consent expressed by continuing to use the Site after reviewing this Policy, as well as the Site Owner's legitimate interest in operating and improving the Site. The detailed conditions of data processing by Yandex and the User's rights in respect of these data are set out in the Yandex documents: "Terms of use of Yandex.Metrica" (https://yandex.com/legal/metrica_termsofuse/) and "Yandex Privacy Policy" (https://yandex.com/legal/confidential/). The User may opt out of data processing by Yandex.Metrica by installing the dedicated Yandex.Metrica browser add-on for blocking data collection, by disabling cookies, or by enabling Do Not Track mode.

9. Additional Provisions

9.1. The Site Owner may make changes to this Policy without the consent of the Site User. Any changes to the Policy come into force from the moment the new version of the Policy is published on the Site. Continued use of the Site after the new version of the Policy is published on the Site means the User's agreement with the changes to the Policy. If the User disagrees with the changes to the Policy that have come into force, the User must stop using the Site by deleting their account on the Site.
